在法律上,赠与是实践合同,只有实际赠与了,即办理了过户手续才完成,不办理过户手续,即使办理公证也没有意义。贷款房的赠与还要妥善处理好还贷的问题,一般应征得银行同意,否则也不是一般意义的赠与。
