上海马建荣律师解答：监事作为公司的一个组成部分其本身是对公司负责的，在履行义务的同时也应该享有权利，所以个人认为监事应该领取相应的工资，当然公司法只是授权股东会对公司监事的报酬事项进行决议，是否有报酬，报酬多少由股东会决定。但是，如果监事与公司签订劳动合同并接受公司指派参加公司管理的话，他们之间还有一层劳动关系，根据劳动法的规定就需要支付相应的报酬。
