广州辛巴哥哥律师解答：公司法第二百一十八条规定：“外商投资的有限责任公司和股份有限公司适用本法；有关外商投资的法律另有规定的，适用其规定。”目前，一般的外商投资公司的注册资本可以适用公司法，就外商投资性公司的注册资本问题，应当根据“有关外商投资的法律另有规定的，适用其规定”，意思是外商投资性公司的注册资本最低不得低于三千万美元。至于首次出资问题，根据公司法“也不得低于法定的注册资本最低限额”，也就是指外商投资性公司的首次出资不得低于三千万美元。
