广州辛巴哥哥律师解答：如果企业歇业很长时间则会被吊销营业执照，被吊销营业执照之后则应当解散企业并办理注销登记。但是实践中，工商局在作出吊销营业执照的裁决时并不要求公司股东解散公司并办理注销登记手续；法律也并没有规定公司长期歇业或被吊销营业执照没有及时清算的法律责任，因此并无面临罚款的法律后果。但是有些法院在审理案件的时候，也会支持债权人因债务人企业被吊销营业执照后没有及时清算而控告其股东的诉讼请求。如果企业要办理注销，则应当首先进入解散清算程序，清算完毕才能注销。企业注销后，债权债务消亡。
