广州辛巴哥哥律师解答:上述做法是有漏洞的。因为根据我国担保法的规定,以土地作为抵押的担保合同的生效时间是在国土房管部门办理登记的时间,因此,若贵公司提供了委托担保业务后等到对方的土地使用权证办下来,一旦对方拒绝签订反担保抵押合同和到国土局去办抵押登记,那么,贵公司便无法取得对该土地的抵押权。
