前两年我们家在农村买了一幢乡下的民房，和该民房主签定了转让房屋合同并办理了公证。
前不久接到消息说该地要被集体征用，政府要给予补偿。于是原房主人找到了我家，说是要和他对分补偿费，因为宅基地的使用权归他所有！我向请教一下，到底应不应该和他对分？为什么？
答：
如果你们家也是那个集体的成员，且已经办理了房屋过户手续，他无权分。如果没有过户，他虽无权分，但是拆迁补偿将通过他进行，会比较麻烦。
如果你们家不是集体成员，你们的购房行为无效，因为集体土地上的房屋只能在集体组织内部流转。拆迁只会面对原主人。当然，我并不能完全排除地方上有土政策的可能性。
